1.Definitions and Amendments

a. For the purpose of these terms and conditions, the customer shall be referred to as the ‘customers’ and Mighty Maid Cleaning Services Limited as ‘Mighty Maid” The term ‘customer’ shall be deemed to include the customers spouse or partner. Also, if applicable registered cleaners introduced to the Customers may undertake varied roles for the customers, but for the purpose of these terms and conditions and all other communications will be referred to as the ‘cleaner(s)’.

b. Mighty Maid reserves the right to amend these terms and conditions if necessary. An up to date copy is always posted on the Mighty Maid website.

c. Mighty Maid shall introduce a cleaner to the customers from its database of approved cleaner(s), on and subject to these terms and conditions.

2.Payment

a. The customer shall arrange a standing order mandate authorising payment to be made by the bank of the customer monthly for the Mighty Maid agency fee. Such payments shall continue until the agency agreement is terminated in accordance with clause 5 of these terms and conditions.

b. Mighty Maid will refund any advance payment upon receipt of termination notice from the customer. See clause 5 cancelation of service.

c. If a cleaner(s) is required for more regular hours than originally stated in the customer/mighty maid agreement, a revised Mighty Maid agency fee will be calculated and confirmed to the customer.Late payment fee – £25.00

3.Mighty Maid Agency Insurance and Liability

a. Mighty Maid take great care when interviewing, vetting and reference checking cleaners to add to our database and although our experience tells us that they very infrequently have accidents in our clients homes, in order to give our customers peace of mind, we provide comprehensive liability insurance. Details are available on request.

b. The customer shall not be covered by the insurance provided by Mighty Maid agency if the cleaner is not introduced by Mighty Maid agency and/or the terms of this agreement are otherwise breached.

c. Mighty Maid agency shall not be liable for any consequential or indirect losses incurred by customer as a result of any failure of a cleaner to comply with his or her contractual obligations for whatever reason. Mighty Maid, have full cover, public and products Liability, employers Liability, and specialist covers.

d. The ownership and responsibility for the return of customer’s keys, remains between the customers, Mighty Maid and the cleaner(s).

e. Force majeure & jurisdiction – Neither party shall be liable for any failure in performance of any of its obligations under this agreement caused by factors outside its control. English Law shall cover this agreement and the parties consent to the exclusive jurisdiction of the English courts in all matters regarding it.

4.Customer obligations

a. The cleaner is introduced to the customers as a self employed cleaner and the customer shall retain the cleaner only under a contract for service. The customer shall agree with Mighty Maid and the cleaner directly the terms of such contract.

b. The customers shall agree with Mighty Maid and the cleaner directly what services are to be performed by the cleaner. A full Mighty Maid assessment of the property is required before work begins.

c. The customer shall pay the cleaner(s) directly.

d. Contact  Mighty Maid agency directly if a temporary cleaner is required due to the regular cleaner’s illness or holiday, as replacements are not automatically supplied, as not all customers require them.Mighty maid will aim to be as flexible as possible to fit in with customers days and hours. In addition Mighty Maid may have to rearrange cleanings days and times if schedules change.

f. The customer shall bear the cost of recovery of agency fees in the event of non-payment.

5.Cancellation of Service

a. Mighty Maid, reserve the right to cancel the service with immediate effect, by phone or email.

b. The customers may cancel Mighty Maid with immediate effect, by phone call or email.

c. For a period of twelve months following termination of the customers/mighty maid agreement the customers shall not engage whether directly or indirectly as an employee, agent or otherwise any cleaner who has been introduced by Mighty Maid to the customers. If the customers so engage(s) a cleaner, then a recruitment fee of 9.5 times the monthly agency fee is payable.

d. The average length of time, customers have stayed with Mighty Maid is 9.5 years.

e. In the event of the customers cancelling the standing order mandate without giving the cancellation notice. Mighty Maid may charge for any reasonable expenses incurred in addition to any outstanding payment due. It is the customers, responsibility to ensure that the standing order mandate paying the Mighty Maid fee is cancelled through the bank of the customers upon termination of the agreement with Mighty Maid. Payments received after cancellation will be returned but will incur an administration fee of £10.00.

f. Once cancelation has been notified a final account will be drawn up and any outstanding balances will be invoiced and any refunds due will be payable back to the customer.

6.Feedback and complaintsThe Mighty Maid cleaning service is guaranteed, please give us feedback about our service, it is really important to help us maintain our standards. Problems and complaints must be reported within 24hrs of the cleaning.

7. Confidentiality and Data Protection –The data we collect from customers is strictly confidential and only used within the Mighty Maid domestic services ltd., business. Mighty Maid does not pass any information on to 3rd party organisations or any other person or business outside the Mighty Maid business. Cleaners who sign up with Mighty Maid sign a confidentiality agreement.

8.GeneralIf any provision of these terms and conditions shall be found to be void, invalid or unenforceable, whether by a court of law, agreements of the parties or otherwise, the remainder of this agreement shall remain in full force and effect notwithstanding any such invalidity, illegality or unenforceability but the provision in question will either be amended so as to make it valid, legal and enforceable or in the event that this is not possible, deleted.

9.Engaging The Mighty Maid service– The above terms and conditions are valid from the 1st day cleaning commences.
